1. Service Description

ProductDesc.ai is an AI-powered platform that generates product descriptions, titles, bullet points, and SEO keywords for e-commerce sellers. Our service uses artificial intelligence to transform product data into optimized marketing content tailored for various online marketplaces.

• AI-generated product descriptions, titles, and bullet points.
• SEO keyword suggestions for product listings.
• Marketplace-specific content optimization (Amazon, Shopify, eBay, Etsy, and others).
• Bulk description generation via CSV upload.
• Content management and export tools.

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice.

2. User Accounts

To use certain features of our service, you must create an account. You agree to:

4. Intellectual Property Rights

• Our Marks: The ProductDesc.ai name, logo, and all related names, logos, and product and service names are our trademarks. You may not use these marks without our prior written permission.
• Service Content: The underlying AI models, algorithms, software, and infrastructure that power the service are our proprietary property.
• No Reverse Engineering: You may not decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code of our service or AI models.

5. AI-Generated Content Ownership

ProductDesc.ai uses artificial intelligence to generate product descriptions and related content based on your inputs. The following terms apply to such content:

• Your Input: You retain all ownership rights to the product data, descriptions, and other content you provide as input to the service.
• Generated Output: You own the AI-generated product descriptions, titles, bullet points, and SEO keywords produced through your use of the service. You are free to use, modify, publish, and distribute this content for commercial and non-commercial purposes.
• License to Process: By submitting product data to our service, you grant us a limited, non-exclusive license to process your data through our AI models solely for the purpose of generating the requested output.
• No Guarantee of Uniqueness: AI-generated content may be similar to content generated for other users with similar inputs. We do not guarantee that generated content is entirely unique or free from resemblance to other outputs.
• Responsibility for Output: You are solely responsible for reviewing, verifying, and ensuring the accuracy and compliance of any AI-generated content before using it in commerce or publishing it publicly.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• ProductDesc.ai IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
• WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, SUITABLE FOR ANY PARTICULAR PURPOSE, OR FREE FROM ERRORS OR OMISSIONS.
• IN NO EVENT SHALL PRODUCTDESC.AI, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
• OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US DURING THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

7. Termination

We may terminate or suspend your access to the service immediately, without prior notice, for any reason, including but not limited to a breach of these Terms.

• By You: You may stop using the service at any time and delete your account through your account settings or by contacting us.
• By Us: We may terminate or suspend your account if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or harmed other users or the service.
• Effect of Termination: Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination shall remain in effect, including sections on Intellectual Property, AI-Generated Content Ownership, Limitation of Liability, and Governing Law.
• Data After Termination: We will retain your data for up to 30 days after termination to allow for potential reinstatement. After this period, your account data and generated content will be permanently deleted.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or the service shall be resolved in the courts located in the United States, and you consent to the personal jurisdiction of such courts.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

9. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the service after changes constitutes acceptance of the updated Terms.
